This Privacy Policy explains how we collect, use, store, share, and protect your information when you use: the MySmartMind web app, mobile apps, AI assistant “Mali”, learning content, and any related services (collectively, the “Services”). By creating an account or using our Services, you agree to this Privacy Policy.

“MySmartMind,” “we,” “us,” or “our” refers to MySmartMind LLC, a company based in Florida, USA. “You” refers to the individual using our Services.

We collect information in three main ways:

1.1 Information You Provide Directly

Account & Profile Information

  • Name
  • Email address
  • Encrypted password
  • Language preferences (e.g., English, Portuguese, Spanish)
  • Subscription plan and status
  • Optional profile settings and preferences

Uploaded Content (Your World, Your AI)

Our platform allows you to upload content so Mali can learn from your world. This may include:

  • Documents, PDFs, text files, notes, or books
  • File names and metadata
  • Tags, labels, or categories you assign
  • AI embeddings or internal representations created only to power your experience

We do not use your private documents to train public models or to build services for other users.

Support & Communication

  • Emails and messages you send to support
  • Feedback, survey responses, and feature requests
  • Other information you choose to share with us

1.2 Information Collected Automatically

Even if you do not create content, some information is collected automatically to operate and secure the Services.

Technical / Device Data

  • IP address
  • Device type, operating system, and browser type
  • Language and time zone
  • App version and configuration
  • Error, crash, and performance logs

Usage Data

  • Pages you visit or screens you view
  • Features you use (chat, learning, documents, etc.)
  • Time and duration of sessions
  • Basic interaction events (e.g., sign-ins, button taps)

Payment Platforms

When you purchase a subscription, payments are processed by third parties such as:

  • Apple App Store
  • Google Play

We may receive:

  • Payment status and subscription details
  • Transaction references and non-sensitive billing metadata
  • Last 4 digits of your card (Stripe), where applicable

We do not store full credit card numbers.

AI & Cloud Providers

To generate responses and process your documents, we may send your data to:

  • Amazon Web Services (AWS), including Amazon Bedrock (Haiku, Nova Lite)

This processing is limited to providing the Services you request (e.g., answering a question, summarizing a document).

2. How We Use Your Information

We use your information for the following purposes:

  • Create and manage your MySmartMind account
  • Authenticate you securely
  • Provide AI chat and learning experiences
  • Process your uploaded documents and files for your personal use

2.2 Personalization & AI Experience

  • Tailor Mali’s responses to your language, topics, and preferences
  • Use your uploaded content to give context-aware answers just for you
  • Surface relevant lessons or tools based on your interactions

2.3 Payments & Subscription Management

  • Process purchases and renewals through Stripe, Apple, or Google
  • Verify active subscription status and plan entitlements
  • Prevent fraudulent or unauthorized transactions

2.4 Security & Abuse Prevention

  • Detect suspicious logins or account misuse
  • Protect our Services from abuse, spam, and attacks
  • Enforce our Terms of Use and other policies

2.5 Improvements & Analytics (Future-Ready)

As we evolve, we may use diagnostic data and optional analytics to:

  • Debug errors and crashes
  • Measure feature adoption and performance
  • Improve quality, accuracy, and usability of the Services

If we use additional analytics tools, we will provide disclosures and opt-out options where required.

3. How We Share Your Information

We do not sell your personal information. We share it only in the ways described below.

3.1 Service Providers

We share information with trusted providers who help us operate MySmartMind, such as:

  • Cloud hosting and infrastructure: AWS (Amplify, Lambda, S3, DynamoDB, API Gateway, Bedrock)
  • Web hosting: Hostinger (for public website and landing pages)
  • Payments: Stripe, Apple App Store, Google Play billing
  • Email communications: Email providers (for account and support emails)

These providers may access your information only to perform services on our behalf, under contractual confidentiality and security obligations.

3.2 AI Processing

To generate responses to your prompts and process your content, we may send data to Amazon Bedrock models (such as Haiku or Nova Lite). This is done strictly to provide the AI functionality you request.

3.3 Business Transfers

If we are involved in a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any material changes to how your information is handled.

3.4 Legal Requirements

We may disclose information if we believe in good faith that such disclosure is reasonably necessary to:

  • Comply with any applicable law, regulation, or legal process
  • Protect the rights, property, or safety of MySmartMind, our users, or the public
  • Detect, prevent, or respond to fraud, security, or technical issues

4. How We Protect Your Information

We use a combination of technical, organizational, and administrative safeguards designed to protect your information, including:

  • Encryption in transit (HTTPS/TLS)
  • Encryption at rest for stored data (using AWS capabilities where applicable)
  • Role-based access controls and least-privilege access
  • Audit logging where appropriate
  • Regular updates and patches to critical systems

However, no security system is completely perfect. You are responsible for keeping your password confidential and securing your devices.

5. Your Rights & Choices

Depending on your location, you may have certain rights regarding your personal information. These may include:

  • Access – Request a copy of your personal data.
  • Correction – Ask us to correct inaccurate data.
  • Deletion – Request deletion of your account and certain data.
  • Portability – Request export of your data in a portable format.

MySmartMind is operated from the United States and uses global cloud infrastructure (such as AWS). As a result, your information may be transferred to, stored, and processed in countries other than your own.

Where required by law, we implement appropriate safeguards for international transfers, such as Standard Contractual Clauses or other legally recognized mechanisms, to help ensure your data is protected.

7. Data Retention

We retain your information only for as long as necessary to fulfill the purposes described in this Policy, or as required by law.

Uploaded documents & files Until you delete them or delete your account. We may keep secure backups briefly for disaster recovery.
AI embeddings derived from your files Deleted or rendered unusable when the underlying file is deleted or your account is closed.
Payment & billing records Up to 7 years, as required for tax and accounting compliance
Support communications Duration of the support case, plus up to 12 months
Technical logs & diagnostics Typically 12–24 months, unless retained longer for security or legal reasons

8. Children’s Privacy

Our Services are not intended for children under the age of 13 (or under 16 in the EU/UK). We do not knowingly collect personal information from children in these age groups.

If you believe a child has provided us with personal information, please contact us at privacy@mysmartmind.com, and we will take appropriate steps to delete such information.

9. Cookies & Analytics

Current State:

We currently use only essential cookies and similar technologies required for security and core functionality (such as keeping you signed in).

Future Analytics:

In the future, we may introduce analytics tools (for example, to understand feature usage or app performance). If we do:

  • We will request consent where required by law.
  • We will provide ways to opt out where applicable.

10. Your Uploaded Documents & “Your World, Your AI”

A core part of MySmartMind is allowing you to bring your own world—documents, notes, PDFs, and more—so Mali can help you in a more personal and contextual way.

What We Do Not Do

  • We do not use your private documents to train public or third-party models.
  • We do not sell or rent your uploaded content.
  • We do not share your documents with other users.

What We Do

  • Store your documents securely using AWS infrastructure, with encryption at rest and in transit where applicable.
  • Create internal representations (embeddings) of your content only to improve your personal AI experience.
  • Use your content to answer your questions, generate summaries, and perform tasks you request.
  • Delete or anonymize these representations when you delete the associated content or your account, subject to brief backup retention.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will update the “Last updated” date at the top of this page.

For material changes (such as new data uses or additional categories of recipients), we will notify you via email, in-app notice, or other reasonable means, and, where required, obtain your consent.

If you continue to use the Services after the updated Policy becomes effective, you agree to the revised Policy.
