1. Agreement to Terms
These Terms & Conditions (“Terms”) govern your use of MySmartMind LLC’s products, websites, apps, AI assistant “Mali,” learning content, and all related features (“Services”).
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
2. Eligibility
You must be at least 13 years old (or 16 years old where required by law) to use MySmartMind.
By using the Services, you represent and warrant that:
- You meet the minimum age requirements.
- You have the legal capacity to enter this agreement.
- Your use complies with all applicable laws.
3. Your Account
You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity under your account.
- Ensuring your information is accurate and up to date.
4. User Content & Uploads
MySmartMind allows you to upload documents, notes, texts, and files to personalize your AI experience. This content is considered User Content.
You retain ownership.
You own all rights to your uploaded User Content.
You grant us a limited license to operate the Service.
By uploading content, you grant MySmartMind a limited, revocable, non-transferable license to:
- Store your files securely.
- Create embeddings or internal representations to power AI features.
- Process your content solely to provide responses and features you request.
We never:
- Sell your content.
- Train public AI models on your content.
- Share your documents with other users.
5. Acceptable Use
You agree not to misuse MySmartMind. Prohibited activities include:
- Uploading illegal or harmful material.
- Attempting to hack, reverse-engineer, or disrupt the Services.
- Using the AI to generate harmful, dangerous, or misleading outputs.
- Sharing copyrighted content that you do not own.
6. AI Disclaimer
Mali is an AI assistant, not a human expert.
All AI-generated outputs, answers, summaries, or suggestions:
- May be inaccurate or incomplete.
- Are not a substitute for professional advice.
- Should not be relied on for medical, legal, financial, safety, or other regulated decisions.
You agree that you are responsible for how you use the AI output.
7. Subscriptions & Payments
Subscriptions may be purchased through:
- Stripe (web)
- Apple App Store
- Google Play Store
Renewals
All subscriptions renew automatically unless canceled before the renewal date.
Refunds
MySmartMind LLC does not provide refunds except where required by applicable law.
App Store and Google Play purchases must follow their own refund policies.
8. Service Availability
We aim for 24/7 availability but do not guarantee uninterrupted service. We may update, suspend, or discontinue portions of the platform at any time.
9. Intellectual Property
MySmartMind’s branding, design, software, content, and AI models (excluding your uploads) are owned by MySmartMind LLC and protected by law.
10. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Cause harm or risk to the platform
- Use the service illegally or fraudulently
You may close your account at any time.
11. Limitation of Liability
To the maximum extent permitted by law:
- MySmartMind LLC is not liable for indirect, incidental, or consequential damages.
- Total liability shall not exceed the amount you paid in the past 12 months.
- We are not responsible for decisions made based on AI output.
12. Arbitration Agreement & Class Action Waiver
By using MySmartMind, you agree that any dispute between you and MySmartMind LLC will be resolved through binding arbitration rather than in court.
No class actions
You agree to resolve disputes only on an individual basis— not as part of a class, collective, or representative action.
13. Changes to These Terms
We may update these Terms from time to time. Continued use of the Services means you accept the updated Terms.
